Article 1

Scope of Application

1. Contracts that are related to the accommodation shall be stipulated in this term and condition. Other matters that are not stated in these articles shall be governed by laws and regulations, or by established customs.
2. If the atelier consent to a special agreement that does not violate laws and customs, that special agreement shall take precedence above the provisions of the preceding paragraph.

Article 2

Application for an Accommodation Contract

1. People who wish to apply for an accommodation contract with the atelier must provide the following:
(1) Guest name
(2) Date and estimated time of arrival
(3) Accommodation charges (according to the basic accommodation charges in table 1)
(4) Other matters that deemed necessary by the atelier
2. If a guest requests to prolong their stay past the accommodation date specified in number (2) of the preceding paragraph, the atelier will handle the request as applying a new accommodation contract at the time the request is made.

Article 3

Establishment of Accommodation Contract, Etc.

1. The accommodation contract shall be concluded when the atelier accepts the application set ahead in the preceding article. This does not apply if the atelier proves that it has not given assent.
2. When an accommodation contract is concluded in accordance with the provisions of the preceding paragraph, the application fee specified by our atelier must be paid by the date set by the atelier. The application fee is limited to the basic accommodation fee for the accommodation period (or 3 days if it exceeds 3 days).
3. The deposit shall be applied to the final accommodation charge, and in the event that a situation arises in which the provisions of Article 6 and 18 apply, the deposit shall be applied in the order of cancellation charges and then compensation. If there is remaining balance, it will be refunded at the time of payment of charges as mentioned in Article 12.
4. If the application fee in paragraph 2 is not paid by the date specified by the atelier in accordance with the provision of the same paragraph, the contract will become invalid. This only applies if the atelier notifies the guest of this fact when specifying the due date of the application fee payment.

Article 4

Special Agreement that does not Require Application Fee Payment

1. regardless the provision of Paragraph 2 of the preceding article, the atelier may enter into a special agreement that does not require the payment of the application fee in the same paragraph after the conclusion of the contract.
2. If the atelier does not request the payment of application fee set forth in Paragraph 2 of the preceding article, or does not specify the payment date for the application deposit when accepting application for accommodation contract, it will be handled as written in the special agreement.

Article 5

Refusal of Accommodation Contract

​The atelier may not accept the conclusion of an accommodation contract in the following cases:
(1) When the application does not comply with these terms and conditions.
(2) When there are no rooms available due to full occupancy.
(3) When it is deemed that there is a risk that the person seeking accommodation may engage in acts that violate the provisions of laws and regulations, public order, or good moral conduct regarding accommodations.
(4) When the person who intends to stay is deemed to fall under any of the following a to c:
a. Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991)Article 2. Organized crime groups prescribed in number 2 (hereinafter referred as “organized crime groups”), prescribed in Article 2 number 6 of the same article. Organized crime group members (hereinafter referred to as “organized crime group members”), associate members of organized crime groups, people related to organized crime groups, and other antisocial forces.
b. When the organized crime group or organized crime group member is a corporation or other organization that controls business activities.
c. A corporation that has one of its members who is a member of an organized crime group.
(5) When the person intending to stay overnight engages in behavior that causes significant inconvenience to other guests
(6) When the person that apply for the accommodation is clearly recognized bearing a contagious disease.
(7) When violent demands were made regarding accommodation, or a burden exceeding a reasonable range was demanded
(8) When the accommodation is not possible due to natural disasters, facility failures, or other unavoidable situations.
(9) When the case falls under the provisions of the Kobe City Inn Business Act Construction Ordinance (Article 9).
a. The person who is applying for the accommodation does not have the ability to pay the accommodation fee.
b. The body, clothes, etc. of the person who is going to stay are extremely dirty, and it is recognized that there is a risk of causing trouble to other guests.
c. The person who is applying for the accommodation is drunk, or the behavior of the person who intends to stay is extremely abnormal, and it is recognized that there is a risk of causing trouble to other guests.

Article 6

The Guest`s Right to Terminate the Contract

1. The guest may cancel the accommodation contract by making a request to the atelier.
2. If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest, the atelier will cancel the accommodation contract in whole or in part due to reasons attributable to the guest (this excludes cases where the atelier specifies the payment date and request payment of the application fee in accordance with the provisions of Article 3, Paragraph 2, and when the guest cancels the accommodation contract before the payment is made), the guest will be charged a penalty fees .(Settings of penalty fees vary depending on each reservation platform (booking engine) and plan, and are subject to the policies of each platform.)However, in the occurrence that the atelier accepts the special agreement, the atelier will inform the guest of the required penalty fee when the guest cancels the accommodation contract.
3. If the guest does not arrive by 8:00 p.m. on the arrival date (if the estimated arrival time is specified in advance, 2 hours after that time), the contract will be treated as having been canceled by the guest without informing the guest.

Article 7

The Atelier`s Right to Terminate the Contract

1. The atelier may cancel the accommodation contract in the following cases:
(1) When the guest is deemed to be at risk of committing an act that violates the provisions of laws and regulations, publicorder, or good moral conducts regarding accommodation, or when it is recognized that the guest has committed such act.
(2) When the guest is deemed to fall under any of the following:
a. Organized crime groups, organized crime group members, organized crime group associate members, persons related to organized crime groups, and other anti-social forces.
b. When the organized crime group or organized crime group member is a corporation or other organization that controls business activities.
c. A corporation that has one of its members who is a member of an organized crime group.
(3) When a guest engages in behavior that causes significant inconvenience to other guests.
(4) When the guest is clearly recognized bearing a contagious disease.
(5) When violent demands were made regarding accommodation, or a burden exceeding a reasonable range was demanded
(6) When the accommodation is not possible due to reasons caused by force majeure such as natural disasters.
(7) When the case falls under the provisions of the Kobe City Inn Business Act Construction Ordinance (Article 9
(8) Smoking in the room, impairment to firefighting equipment, etc., and other usage regulations stipulated by the hotel whent he prohibited matters (limited to those necessary for fire prevention) are not abide by.
2. When the atelier cancels the accommodation contract based on the provisions of the preceding paragraph, the guest
will not be charged for accommodation services that has not been provided to the guest.

Article 8

Accommodation Registration

1.Guests are required to register the following items on the day of their stay from the atelier tablet or on the My Page on the website:
(1) Guests name, age, gender, address, and occupation
(2) For foreigners: nationality, passport number, place of entry, and date of entry
(3) Departure date and scheduled departure time
(4) Other matters deemed necessary by the atelier
2. If the guest intends to pay the charges set forth in Article 12 using a method that can be substituted for currency, such as travelers check, accommodation voucher, or credit card, the guest must present these in advance at the time of registration as set forth in the preceding paragraph.

Article 9

Accommodation Hours

1. Guests may use the guestrooms from 3:00 p.m. to 11:00 a.m. the following day. For staying for consecutive nights however, the guests may use it for the entire day excluding the day of arrival and the day of departure.
2. Notwithstanding the provisions of the preceding paragraph, the atelier may accept requests for guestrooms usage outside the hours specified in the same paragraph. In this case, the following additional fees will be charged:
(1) 1/3 of the room charge for up to 3 hours
(2) 1/2 of the room charge for up to 6 hours
(3) For over 6 hours or more, the full amount of the room charge will be charged

Article 10

Regulatory Compliance

Guests are required to comply the terms and conditions stipulated by the atelier.

Article 11

Business Hours

1. The business hours of the main facilities of the atelier are provided in pamphlets, bulletin boards in several places, service directory in the guestrooms, etc.
2. The hour may be changed temporarily if necessary. In that case, the atelier will notify you by an appropriate method.

Article 12

Payment of Fees

1. The details of the accommodation charges, etc. to be paid by the guest are listed in Table 1.
2.Payment of the accommodation fees, etc. mentioned in the preceding paragraph must be made in advance on My Page on the website in currency or by alternative methods approved by the atelier, such as traveler’s checks, accommodation coupons, credit cards, etc., or on the reception tablet at guest check-in when requested by the atelier.
3. The accommodation fee will still be charged even if the guest voluntarily chooses not to stay after theatelier has provided guest room to the guest and the guest is able to use the room.

 

Article 13

The Atelier liability

1. The atelier shall compensate the guest for any damages arising from failure to execute the accommodation contract or its related agreements. This does not apply for reasons that is not applicable to the atelier
2. With nature preservation in mind, our atelier preserves the nature of Mt. Rokko as much as possible, providing a space where you can enjoy nature as it is. Please note that the atelier is not responsible for the following matters:
(1) Accidents and theft on the premises (including parking lot)
(2) Accident between customers
3. The atelier has liability insurance to protect against fire.

Article 14

Handling When the Contracted Room
Cannot be Provided According to the Agreement

1. If the atelier unable to provide the contracted guestroom to the guest, the atelier shall obtain the guests consent and arrange other accommodation facilities under as similar conditions as possible.
2. Notwithstanding the provisions of the preceding paragraph, if other accommodation unable to be provided, the atelier will pay compensation fee equivalent to the cancellation fee, which will be allotted to damages. However, if there is no reason attributable to the atelier for not being able to provide the guestroom, the atelier will not pay the compensation fee.

 

Article 15

Handling of Checked Items

1. The atelier does not store guests luggage, cash, or valuables.
2. Storage of guests luggage, cash, and valuables is the responsibility of the guests, and the atelier will not take any responsibility for the storage.
Please make sure to take valuables and lock the room when about to go out.
Please take the same precautions when opening the room even for a short period of time.
In addition, items such as computers and tablets that cannot be carried should be placed in a bag, etc. Please be careful when storing the item and keep it out of sight.

Article 16

Storing Guest Luggage and Belongings

1. The atelier does not store guestsluggage or personal belongings.
2. In the event that the luggage or personal belongings are left behind in the atelier after the guest has checked out, the atelier will contact the owner and give instructions after the owner is identified. However, if the owner cannot be identified or if there is no instruction from the owner, the item will be kept for 7 days from the discovery date, and then delivered to the nearest police station.

Article 17

Parking Liability

When a guest uses the parking lot of the atelier, regardless of whether or not the key of the vehicle is entrusted, the atelier lends the place and does not take responsibility for the management of the vehicle. However, the atelier shall be liable for compensation for any damage caused by willful misconduct or negligence in managing the parking lot.

Article 18

Guest Liability

1. If the atelier suffers damage due to intention or negligence of the guest, the guest will be required to compensate the atelier for the damage.
2. Please be aware that the guest will be held responsible for any damage caused to the building, equipment, etc. on the premises of the atelier or in the building, either intentionally or through carelessness on the part of the guest.
3. The atelier leaves nature as it is. Therefore, there are steep slopes, falls on cliffs, and other dangers on the premises. The accommodation contract of the atelier shall be deemed to have been accepted by the guest. The atelier will not be held responsible for any injuries or other damages that may occur to guests on the atelier premises or within the building. Please be especially careful with small children.
4. Please be aware that the guest will be held responsible for any damage to buildings, equipment, etc., either intentionally or due to carelessness, on the lands of the atelier or within the building.
